Agreement to Terms

By downloading, installing, or using the Dosewell application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Dosewell is a personal medication reminder application designed to help you track and remember your medications. The App uses end-to-end encryption to protect your medication data.

Important Disclaimers

Not Medical Advice

• The App is a reminder tool only and is not intended to diagnose, treat, cure, or prevent any disease or health condition
• The App does not replace professional medical advice, diagnosis, or treatment
• Always consult with a qualified healthcare provider regarding any medical conditions or medications
• Never disregard professional medical advice or delay seeking it because of something related to this App

Not a Substitute for Professional Care

• Do not rely solely on Dosewell for medication management in life-threatening or critical health situations
• The App is intended as a supplementary tool to assist with medication reminders, not as a primary medical management system
• You are solely responsible for taking your medications correctly and on time

No Guarantee of Reminder Delivery

While we strive to deliver all reminders reliably, we cannot guarantee that:

• Reminders will be delivered at the exact scheduled time
• Reminders will be delivered at all (due to device settings, network issues, or other factors beyond our control)
• The App will function without interruption or errors

You should not rely on Dosewell as your only method of remembering critical medications.

User Responsibilities

By using Dosewell, you agree to:

• Provide accurate information when creating your account
• Maintain the security of your account credentials
• Use the App only for lawful purposes
• Not attempt to circumvent, disable, or interfere with security features of the App
• Not use the App for any purpose other than personal medication reminders
• Take responsibility for your own medication management and health decisions

Encryption and Data Access

Your Data, Your Control

• All medication data is encrypted on your device before transmission
• We do not have access to your unencrypted medication data
• You are responsible for maintaining access to your encryption keys (stored on your device)
• If you lose access to your device and have not enabled recovery options, your encrypted data may be permanently inaccessible

Data Loss

We are not responsible for:

• Loss of data due to device loss, damage, or failure
• Inability to recover encrypted data
• Data loss resulting from user error

Intellectual Property

The App, including its design, features, and content, is owned by Dosewell and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract the source code
• Use the App's branding or trademarks without permission

Limitation of Liability

WE DISCLAIM ALL LIABILITY FOR:

• Any health outcomes, adverse effects, or medical emergencies that may occur
• Missed doses or incorrect medication intake
• Failure of reminders to be delivered
• Any damages arising from your use or inability to use the App
• Any damages arising from unauthorized access to your data
• Any indirect, incidental, special, consequential, or punitive damages

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Dosewell, its owners, operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any claim that your use of the App caused damage to a third party

Medical Emergency

Termination

We may terminate or suspend your access to the App at any time, without notice, for any reason, including if you violate these Terms.

You may stop using the App and delete your account at any time.

Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for violations of intellectual property rights.

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dosewell regarding your use of the App.
